Apple, AT&T Hit With Class-Action Lawsuit

All the problems with Apple’s new iPhone 4 have prompted some customers to launch a class action lawsuit. There are a variety of issues cited, but mainly involve the yellow tint on the screen and problems with reception when holding the phone in a certain way – aka ‘death grip’. The suit also cites the issues of customers who cannot return their phones without incurring re-stocking fees. Apple charges a 10-percent re-stocking fee on any opened hardware or accessory returned.

Overall, the suit accuses Apple of defect in design, manufacturer, and assembly as well as breach of express warranty. Apple and AT&T are accused of general negligence, breach of warranty, deceptive trade practices, intentional misrepresentation, negligent misrepresentation, and fraud by concealment.
