MegaUpload Criminal Trial May Never Happen

The MegaUpload takedown has been a farce since January 19th when the site was forceably taken offline, along with its various sister sites such as MegaVideo. The site’s founder, Kim Dotcom, has had many charges levelled against him, including copyright infringement, money laundering and other crimes. However, other than shutting down these sites, the US government and the FBI have had one setback after another for various reasons. These included an inability to extradite Dotcom from New Zealand to stand trial in the US and inability to wipe the data off the impounded servers due to concerns of legitimate data stored on there and other reasons.

Now, it looks like the criminal trial against Dotcom may not even come to pass. And the reason? Paperwork. It’s not possible to file criminal papers against a company in another country, since they are out of the USA’s jurisdiction. This inconvenient truth was pointed out by US judge Liam O’Grady. Therefore, Dotcom may never be formally served with criminal proceedings.
